Is Elena Kagan a "scapegoat" for Utilitarianism's gay-rights campaigners?

Is it fair to say that the Supreme Court Justice nominee is not gay but her uality seems to have been used by utilitarianists like Andrew Sullivan who want to see gay rights and gay acceptance? Therefore she has been scapegoated or sacrificed for "utility"? Am I on the right track?
